Terms and Conditions of Hire

Set out below are the terms and conditions of hiring a bicycle with Prompt Cycle Culture.

1. CYCLE HIRE TERMS AND CONDITIONS

1.1 Prompt Cycle Culture aim is to provide high quality carbon road bike hire for our clients, but to achieve this at a reasonable cost we ask our customers to treat the equipment responsibly as they would their own bike.
1.2 Equipment can only be hired from Prompt Cycle Culture on completion of a Hire Agreement Form in store or by accepting our terms and conditions through our ‘Online Booking’ process. Upon acceptance of these Terms & Conditions a binding contract is formed between Prompt Cycle Culture and the hirer.
1.3 Prompt Cycle Culture reserve the right not to accept or to fulfil a booking and in such circumstances no refund of payments made are due.
1.4 Original photographic identification, such as passport, national id card or driving licence will be required to be held by Prompt Cycle Culture for the duration of the hire, if you do not agree to this condition please do not proceed to hire.
1.5 Where a booking is made by one person on behalf of another person or group, the lead person confirms to Prompt Cycle Culture that he or she has the authority to make such a booking.
1.6 Bookings will only be accepted from persons over the age of 18 years.
1.7 The hire period commences on the day the cycle(s) and equipment are collected by you and continues until the cycle(s) and equipment is returned to Prompt Cycle Culture.
1.8 All cycles are presented in good working order and are serviced and setup by our mechanics prior to each rental, therefore Prompt Cycle Culture will only accept general wear and tear during the hire period. You will be asked to inspect the cycle(s) on collection to confirm it’s condition prior to hire.
1.9 Your hire price includes a basic fit. Saddle height and stem length / height can be adjusted if provided at least 7 days in advance. We will try our best to replicate your preferred position but this is not always possible. A more exact fit can also be demanded. As this is time consuming we charge for this service. Again this must be provided 7 days in advance. please visit our bike measurements page for more details.
1.10 No changes to the cycle(s) are allowed without our permission.
1.11 We reserve the right to immediately terminate the hire and retain deposits should any of the terms and conditions set out in this document be broken.

2. CLIENTS TERMS AND CONDITIONS

2.1 You are responsible for ensuring that you are physically fit enough to undertake cycling any distance or compete in events using Prompt Cycle Culture cycle(s) or equipment you have booked. Prompt Cycle Culture does not accept any responsibility for failure to complete hire period due to lack of fitness, injury or illness.
2.2 Prompt Cycle Culture does not accept liability for personal injury: loss or damage or personal effects to any participant; nor can Prompt Cycle Culture accept any responsibility for delays or changes to the period of hire due to war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, disease, adverse weather, travel delays other unforeseen circumstances that amount to force majeure.
2.3 Hirers are responsible for accepting that cycling on a public highway and in the mountains carries its own inherent risks including inclement weather and accidents in remote places, which might cause them or others injury or loss, or damage their or others property. Despite these risks the hirers accept sole responsibility for their own safety and for the above risks They will not make any claim against PROMPT CYCLE CULTURE in respect of any injury or loss suffered by them or others; or any damage to any of their or others property regardless of how the injury, loss or damage occurred.
2.4 Hirers must ensure you always ride our cycle(s) responsibly, and you cannot hold Prompt Cycle Culture responsible for any loss: damage or injury including death to persons or property with regard to the use of the cycle(s) and equipment hired. You accept responsibility to Indemnify Prompt Cycle Culture against any claim demand or expense in respect of such injury or damage.
2.5 The use of helmets is not a condition of hire, but we strongly recommend them. Helmets can be hired from us. If you need medical help call emergency number 112, translators are available on this number.
2.6 You are responsible for ensuring that you have suitable travel Insurance cover during the period of your hire. Prompt Cycle Culture may offer you a damage waiver insurance as part of the booking, but. loss, theft or broken frame are not covered by this insurance and any damage resulting during the rental will incur full cost for repair or replacement for damage or loss to the client.
2.7 In the event that a cycle(s) is lost, stolen or damaged beyond repair you agree to pay 2000euros (per cycle) to replace the lost, stolen or damaged cycle(s).
2.8 You are responsible for all cycle(s) and equipment hired, keeping these items safe from damage: loss or theft, and use it in a proper manner and not subject it to any misuse or unfair wear and tear. All items when left unattended must be locked to a secure object and this must include all removable items such as the front wheel and frame. Always lock the item when you leave it, you are responsible for the hire item and will be liable for any loss or damage to - Don’t leave the bike on the street or outside restaurants unguarded and you must ensure all items are kept secure inside your apartment/ villa both night and day when not in use.
2.9 Any damage caused to cycle(s) due to crash or neglect is the client’s responsibility and this will be charged in full for any repairs or replacement required. In the event of any damage to the bike Prompt Cycle Culture decision on the cost of the damage is final and by taking the hire you agree to pay for the damage in full subject to the level of cover you took as part of the Damage Waiver Option at the time of booking. Any damage waiver does not cover the theft or loss of the bike. You as the hirer are full responsible for returning the bike at the end of your hire.
2.10 We reserve the right to retain all or part of the damage deposit should the hire item be brought back in a damaged or unreasonable condition. This does not apply in the case of a fault which is considered to be the result of fair wear and tear.
2.11 All the hire items are maintained by us and are hired to you in a serviced state. If you have any issues which are a result of mechanical failure and not hirer negligence, we will of course repair the hire item for free. However if you fail to look after the hire item and through the hirer's negligence a fault occurs then a fee will be deducted from your damage deposit.
2.12 We reserve the right to reclaim monies for damage beyond the cost of the deposit. Furthermore we reserve the right to retain the Hirers property until all outstanding repair invoices are cleared.
2.13 You must notify Prompt Cycle Culture immediately of any breakdown, loss: damage or theft to the hired cycle(s) or equipment however caused. You will be responsible for paying Prompt Cycle Culture the reasonable costs of repair or replacement for any such loss, damage or theft. In the case of theft or accident the client must also notify the local police immediately.
2.14 Any repairs undertaken by you are your responsibility and no reimbursement will be given to you for the cost of any such repairs.
2.15 In the event of mechanical breakdown it is your responsibility to return the cycle(s) to Prompt Cycle Culture in a safe and proper manner and without causing further damage.
2.16 All cycle(s) and equipment hired under this agreement remain the property of Prompt Cycle Culture. You must not offer for sale, lend or otherwise part with possession of the hired cycle(s) or equipment during the duration of you hire agreement with Prompt Cycle Culture.
2.17 All property left with Prompt Cycle Culture is done so entirely at the owner’s risk and Prompt Cycle Culture accept no responsibility for any loss, damage or theft to/of it.

3. PAYMENT TERMS

3.1 A non-refundable deposit payment is due and collected on booking.
3.2 Balance payments for general hire (ie non event periods) can be made at any time including on collection of the reserved hire. Where balance payments are made in advance of collection they are non-refundable.
3.3 Balance payments for event periods and other busy times (e.g. Tour de France / La Marmotte / Other cycling events) are due on reservation. An email will be sent to you requesting payment. If you fail to pay the full balance by the date specified in the email your booking will be deemed to have been cancelled by you and no refunds will be due.
3.4 If you are hiring a bike for a cycling event or sportive and the event is cancelled or postponed by the organisers no refunds will be due from Prompt Cycle Culture. If you have travelled to do the event then arrangements may be made with us to pick up the bikes for the days hired subject to the conditions shown next in these terms.
3.5 We do not give refunds if we have to cancel or change your reservation arrangements in any way because of war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, disease, adverse weather conditions or other unforeseen circumstances that may amount to force majeure.
3.6 Once the balance is paid and you have taken the cycle(s) on hire no refund is due on any unused hire days, even if you decide the cycle(s) is unsuitable for you or your needs.
3.7 In consideration of our arranging and fulfilling your hire in accordance with these terms and conditions you pay Prompt Cycle Culture the total price for your period of hire, plus a deposit as set out in the Hire Agreement Form in advance of the hire commencing.
3.8 Late return will be charged at the published day hire rate from 6pm, local time, on the day the hire was due to end and for each day/ part day that the returned is late.
3.9 A security damage deposit will be required at the commencement of any hire period, to hold a security deposit to the value €100.00 per bike, and it will be returned at the end of the hire period provided that; Any cycle(s) and/or equipment hired or used are returned in an undamaged condition to Prompt Cycle Culture. Any cycle(s) and/ or equipment hired or used are returned within the arranged hire period at an arranged time and place to Prompt Cycle Culture.
3.10 If the terms set out in 3.9 (above) are not complied Prompt Cycle Culture, reserve the right to make reasonable charges until such time when cycle(s) and/ or equipment concerned have been returned to Prompt Cycle Culture. In the case of cycle(s) and/or equipment theft or returned damaged you are responsible for any costs incurred and sustained in replacing or repairing (whichever the cheaper) the items concerned to a condition equivalent to that prior to the hire.
3.11 In all cases: the security deposit can be used against the costs or charges mentioned herein.

4. PERSONAL SAFETY

4.1 It is the rider’s responsibility for their own safety, as cycling involves personal risk and you must ride responsibly.
4.2 Injury(s) and/or death associated with the sport of cycling may result from weather: excessive speed collision with inanimate objects or other persons: rider inexperience: error or abuse of equipment
4.3 First time users should use the equipment under the supervision of an experienced rider or guide.
4.4 You must not cycle under the influence of alcohol strong medication, other drugs or fatigue.

5. OUR LIABILITY TO YOU

5.1 Prompt Cycle Culture does not accept responsibility for death: personal injury and loss suffered by you.
5.2 Prompt Cycle Culture will not be liable to you where any alleged loss or damage results from: Any of your own actions or omissions; the action or omission of a third party not connected with the provision of your bike hire; an event or circumstances which we could not have predicted or avoided even after taking all reasonable care
5.3 Prompt Cycle Culture’s liability to the hirer under this contract, shall be limited to the total cost of your Booking.
5.4 Prompt Cycle Culture shall have no liability to the client, if we are unable to fulfil a booking, our liability to you shall not exceed to the agreed cost of the hire.

6. GENERAL

6.1 We reserve the right to immediately terminate the hire and retain deposits should these conditions be broken.
6.2 These terms and conditions constitute the agreement between us: and supersede any previous agreement or understanding and may not be varied except in writing between us. All other terms: express or implied by statute or otherwise: are excluded to the fullest extent permitted by law.
6.3 Any notice required or permitted to be given by either of us to the other under these terms and conditions shall be in writing.
6.4 No failure or delay by either of us in exercising any of its rights under these terms and conditions shall be deemed to be a waiver of that right and no waiver by either of us of any breach of these terms and conditions by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.
6.5 If any provision of these terms and conditions is held by any court or other competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these terms and conditions and the remainder of the provision in question shall not be affected.
6.6 Except as otherwise expressly provided herein nothing in these terms and conditions confers or purports to confer on any third party any benefit or any right to enforce any of these terms or conditions.
6.7 These terms and conditions shall be governed by French law: and both of us hereby agree to submit to the exclusive jurisdiction of the French Courts.

In order to hire from us you must indicate that you have read, understood and accept these terms and conditions. If you do not accept them then you are free not to book with us.
